Register the CD key with a Battle.net account(not a Diablo II account, but the thing I linked to). Note that you will not to be able to play online games using the same CD key, but I think you should be able to play via LAN that way. I'm not sure though; I've never tried it. At any rate, the method above you will let you play without the CD in the drive.
Yep, download the PC version and use wineskin. After that you click the + in the window and download the new wineskin engine.
Then after that's done you select that engine and click new blank wrapper. Then you just name the wrapper Diablo 2 or whatever you want, and launch that wrapper. Then the rest is pretty self explanatory. The LoD installer does not recognize that the original is installed because it has been Wineskinned and thus will not allow the installation to commence.
